Hearing Scheduled for North Fork Case Dismissal

A hearing has been set for next month for arguments to dismiss a lawsuit filed against Morehead’s Mayor and four members of the City Council by the former residents of the North Fork Mobile Home Park.

The case filed in Rowan Circuit Court in June alleges three complaints regarding the process the City took in forming the TIF District for a planned development by Patrick Madden of Lexington. The first complaint says the municipality violated state laws which specify the steps local government must take before establishing a development area. The second challenges the sufficiency of facts the City based their findings on to form the district. And the third alleges the notice residents received from the City about the development was insufficient according to the Kentucky Constitution.

Attorney Felisa Moore responded for the officials on July 6th, asking for the suit to be dismissed on the grounds that the former residents lack both constitutional and statutory standing

The plaintiffs are expected to respond to the motion by next Wednesday, and the defendants will have until August 18th to reply.  A hearing on the issue is set for August 31 at 9 a.m.
