North Fork Residents Sue City of Morehead

Some displaced residents of North Fork Mobile Home Park are suing the City of Morehead.

The case filed in Rowan Circuit Court Friday alleges three complaints regarding the process the City took in forming the TIF District for a planned development by Patrick Madden of Lexington. The first complaint says the municipality violated state laws which specify the steps local government must take before establishing a development area. The second challenges the sufficiency of facts the City based their findings on to form the district. And the third alleges the notice residents received from the City about the development was insufficient according to the Kentucky Constitution.

Ben Carter is an attorney with the Kentucky Equal Justice Center who is representing the plaintiffs. He says his clients are not seeking monetary compensation, but instead are seeking to void the agreement between Madden and the City of Morehead.

Carter says while the financing aspect of the North Fork situation is unique, it’s reflective of a larger problem in the Commonwealth with mobile home park residents often being forced from their homes abruptly.
