Senator Wants Breathalyzer Recordings

The Kentucky Commonwealth Attorneys Association does not think the penalty for refusing a breathalyzer test is strong enough. Christian County Commonwealth’s Attorney Mike Foster chairs the organization’s legislative committee.

Right now, he says, if a motorist suspected of driving while intoxicated refuses the test, the person simply loses his or her driver’s license. Foster thinks consideration should be given to a fine or jail time.

State Senator Robin Webb is a criminal defense attorney. The Carter County Democrat thinks police should videotape an officer’s request for a breathalyzer test…

Webb believes if the process were recorded, all the parties involved would be better protected.
